We process your data under Article 6(1)(b) of the GDPR — processing necessary for the performance of a contract or pre-contractual steps taken at your request — and Article 6(1)(f) — legitimate interest in responding to business inquiries.

5. Data Retention

Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected. Contact form submissions are retained for a maximum of 24 months unless an ongoing business relationship requires longer retention.

6. Data Sharing

We do not sell, trade, or share your personal data with third parties except where required by law or where necessary for service delivery (e.g., payment processing via Stripe). All third-party processors are vetted for GDPR compliance.

7. Your Rights

8. Data Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. All data transmissions are encrypted via TLS.

These Terms of Service ("Terms") govern the provision of software development and consulting services by creativedirectionlab ("Provider") to any client ("Client") engaging our services.

1. Scope of Services

Services are defined in individual project proposals or Statements of Work (SOW) provided to the Client. The Provider delivers software development, infrastructure engineering, and related technical services as specified in the applicable SOW.

2. Project Execution

Projects are executed in clearly defined milestones. The Provider commits to delivering each milestone within the timeframe specified in the SOW. Delays caused by the Client (e.g., delayed feedback, changed requirements) may extend delivery timelines proportionally.

3. Payment Terms

Invoices are issued upon milestone completion and are due within 14 days of issuance. Late payments incur a statutory interest rate of 1.5% per month as permitted under Danish law. The Provider reserves the right to suspend work for outstanding invoices exceeding 30 days.

4. Intellectual Property

Upon full payment, all source code, documentation, and deliverables produced specifically for the Client become the Client's intellectual property. Pre-existing libraries, frameworks, and internal tools used by the Provider remain the Provider's property, with a perpetual, non-exclusive license granted to the Client for use within the delivered project.

5. Confidentiality

Both parties agree to maintain strict confidentiality regarding all proprietary information exchanged during the engagement. This obligation survives termination of the agreement for a period of 36 months.

6. Limitation of Liability

The Provider's total liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. The Provider is not liable for indirect, consequential, or incidental damages.

7. Termination

Either party may terminate the agreement with 14 days' written notice. Work completed and accepted prior to termination shall be paid in full. Uncommitted work in progress will be delivered in its current state.

8. Governing Law

These Terms are governed by Danish law. Any disputes shall be submitted to the jurisdiction of the courts of Aarhus, Denmark.

creativedirectionlab operates on a milestone-based payment structure. This Refund Policy outlines the conditions under which refunds may be issued.

1. Milestone-Based Billing

Each project is divided into clearly defined milestones with associated deliverables. Payment for each milestone is invoiced upon completion and client acceptance of the deliverables.

2. Completed Milestones

Milestones that have been delivered and accepted by the Client are non-refundable. By accepting a deliverable, the Client confirms that the work meets the agreed specifications outlined in the Statement of Work.

3. Pre-Paid Uncommitted Work

If the Client has pre-paid for future milestones that have not yet been started, a full refund of the uncommitted amount may be requested. Refund requests must be submitted in writing to [email protected] within 14 days of payment.

4. Work In Progress

Milestones that are partially completed are invoiced proportionally based on documented time and resources invested. Refunds for partially completed milestones are evaluated on a case-by-case basis.

5. Non-Delivery

If the Provider fails to deliver a milestone within the agreed timeframe due to circumstances within the Provider's control, and the Client does not wish to continue, a full refund of the associated milestone fee will be issued within 14 business days.

6. How to Request a Refund

Refund requests should be directed to [email protected] with the subject line "Refund Request — [Project Name]". Include the invoice number and a description of the reason. We will respond within 5 business days.
